Observing the Waiting Period
📖Ṣaḥīḥ al-Bukhari 4954, Ṣaḥīḥ Muslim 1471
Ibn Umar reported: He divorced his wife in the time of the Messenger of Allah ﷺ while she was menstruating. Umar ibn al-Khattab asked the Prophet ﷺ about that, and he said, “Order him to return her. Let him leave her alone until she becomes pure, then menstruates, and then is pure again. If he wishes, he may keep her or divorce her before he is intimate with her. That is the waiting period Allah has commanded for divorcing women.” (65:1)

Description:
This hadith explains the proper observance of the waiting period (‘iddah) in the case of divorce. The Prophet ﷺ corrected the man who divorced his wife while she was menstruating, clarifying that the waiting period is designed to follow her menstrual cycle until she experiences two clean periods. This ensures clarity regarding her purity and prevents any ambiguity about pregnancy. The ruling emphasizes justice, fairness, and respect for women during sensitive situations like divorce.
Link to Pregnancy:
Menstruation is linked to the ‘iddah in this hadith because it helps determine whether the woman is pregnant. By waiting through her menstrual cycles, it becomes clear whether she is pregnant or not, which protects lineage rights and ensures correct application of the divorce. The waiting period therefore serves both as a reflection and purification period and as a practical measure for pregnancy detection.
What We Learn Today:
- Always observe the ‘iddah according to divine guidance.
- Respect the woman’s physical and emotional condition during this time.
- Use the waiting period for reflection before finalizing the divorce.
- Recognize the dual purpose: protecting lineage (pregnancy detection) and ensuring fairness and clarity in the divorce process.
- The waiting period is not arbitrary; it safeguards both spouses, provides time for reflection, and ensures that decisions are made with full understanding of the woman’s condition. It also prevents impulsive or unjust divorces.

Quranic Context:
📖Quran 65:1
O Prophet, when you [Muslims] divorce women, divorce them for their waiting period and keep count of the waiting period, and fear Allah, your Lord. Do not expel them from their houses, nor should they [themselves] leave except in a manner acceptable. And those are the limits set by Allah. Whoever fears Allah – He will make for him a way out.
📖Quran 65:4
And those of your women who have passed menopause, if you divorce them, there is no waiting period required for them. And those who have not yet menstruated—those too, for them is a prescribed waiting period of three months. And for those who are pregnant, their waiting period is until they deliver their term.
These verses clarify that the waiting period is linked to menstrual cycles and pregnancy, confirming the wisdom behind the Prophet’s ﷺ instructions in the hadith.
Umar bin Al-Khattab, may Allah be pleased with him, asked the Messenger of Allah about that, and the Messenger of Allah said: Tell him to take her back and keep her until she becomes pure, then menstruates again and becomes pure again. Then if he wishes he may keep her, or if he wishes, he may divorce her before he touches (has intercourse with) her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.
